Introduction
Humanoid robots entering Europe can sit at the intersection of machinery safety AI rules product liability cybersecurity privacy and workplace obligations. The exact path depends on what the robot does and how its AI is used. A factory humanoid and a home service humanoid can face different product and deployment requirements.
Machinery rules focus on the physical product
The Commission states that Machinery Regulation (EU) 2023/1230 applies from 20 January 2027. Machinery placed on the EU market before then remains subject to Directive 2006/42/EC. This date is separate from the AI Act timetable.
The AI Act can add another layer
The Commission's high-risk guidance distinguishes AI safety components in regulated products from other high-risk use cases. For the product route, both the AI's safety/product role and a third-party conformity-assessment requirement matter; a humanoid label alone does not establish classification.
Timelines must be checked carefully
The Commission's current AI Act page reports the AI Omnibus entering into force on 27 July 2026. It gives 2 August 2028 for high-risk AI embedded in regulated products and 2 December 2027 for the listed high-risk use cases in sensitive areas. The earlier July classification guidance is a draft and is not itself binding law.
Product liability now includes modern software realities
The Commission says Directive (EU) 2024/2853 applies to products placed on the market from 9 December 2026; Member States have until that date to transpose it. Its explanation expressly covers software and AI, including defects that become apparent through updates or machine-learning features. The earlier directive remains relevant to products placed on the market before that date.
Limitations and missing information
- A humanoid's form factor alone does not decide its legal classification. Product role, intended use and the applicable conformity-assessment route still need case-specific review.
Sources and methodology
The European Commission's machinery, AI Act and product-liability pages were consulted on 29 September 2026. EUR-Lex retrieval was blocked; the full legal texts were not inspected. This is a source-reading note, not a determination of conformity for a specific robot.
